Designs provides this site as a service to its customers. Please review the following basic rules that govern your use of our site. Please note that your use of our site constitutes your agreement to follow and be bound by these terms. If you do not agree to these terms, please do not use this site. Although you may "bookmark" a particular portion of eldesignsco.com and thereby bypass this agreement, your use of this site still binds you to the terms.

Unless otherwise noted, all design and content featured on eldesignsco.com, including navigational buttons and images, artwork, graphics, photography, text, and the like-are copyrights, trademarks, trade dress, and/or intellectual property that are owned, controlled, or licensed by E.L. Designs. This website in its entirety is protected by copyright and all other applicable intellectual property laws. All rights, titles, and interests are reserved. The contents of my website and the website as a whole are intended solely for your personal, non-commercial use. Any use of my website and its content for purposes other than personal and non-commercial is prohibited without the prior written permission of E.L. Designs. Do not reproduce, publish, display, modify, sell, or distribute any of the materials from E.L. Designs. You may, however, download or electronically copy and print any of the page contents displayed on the site, but please remember that these are available for your personal, non- commercial use only. Should you choose to download, copy, or forward any site materials via email, no right, title, or interest in those materials will be transferred to you.

LIMITATION OF LIABILITY

Designs does not warrant that the function or operation of this website will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available will be free of viruses or other harmful elements. As a visitor to and user of this website, you must assume full responsibility for any costs associated with the servicing of equipment used in connection with the use of our website. As a visitor to and a user of this website, you, in effect, agree that your access will be subject to the terms and conditions set forth in this legal notice and that access is undertaken at your own risk. E.L. Designs shall not be liable for damages of any kind related to your use of or inability to access this website.

In no event shall E.L. Designs or any owner, employee, or affiliate thereof, be responsible or liable to you, or any third party, whether in contract, warranty, tort (including negligence) or otherwise, for any damages, including by not limited to, special, incidental, indirect or consequential damages that include but are not limited to, damages for any loss of profit, revenue or business, as a direct or indirect result of: (I) your breach or violation of the terms and conditions of this agreement; (II) your access and use of my services; (III) your delay in accessing or inability to access or use my services for any reason; (IV) your downloading of any of the content or the collective work for your use; (V) your reliance upon or use of the content or the collective work or (VI) any information, software, products or services obtained through my services, or otherwise arising out of the use of my services, whether resulting in the whole or in part, from breach of contract, tortious behavior, negligence, strict liability or otherwise, even if I and/or my suppliers had been advised of the possibility of damages.

This limitation shall also apply with respect to damages incurred by reason of other services or goods received through or advertised on the website or received through any links provided in the website service, as well as by reason of any information or advice received through or advertised on the website or received through any links provided in the website service. This limitation shall also apply, without limitation to the costs of procurement of substitute goods or services, lost profits, or lost data. Such limitation shall further apply with respect to the performance or non-performance of the website service or any information or merchandise that appears on, or is linked or related in any way to, the website service. Such limitation shall apply notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent permitted by law.

DESIGN SERVICES

Each user of the Services will receive design recommendations based on the consultation or questionnaire, pictures, videos or other material submitted by the user.  Design is inherently subjective, however, you agree that E.L. Designs cannot and does not warrant or guarantee your satisfaction with design services and/or  ideas you receive on the E.L. Designs website.  Notwithstanding the foregoing, E.L. Designs will take such reasonable steps, in E.L. Designs’ sole discretion, to ensure your satisfaction including, but not limited to those measures set forth in my refund policy.  This offer is valid for thirty (30) days from service purchase date.  Should you have questions, please contact me at erin@eldesignsco.com.

Each user of the Services will receive design recommendations based on the questionnaire, pictures, videos or other material submitted by the user. Design is inherently subjective; however, you agree that E.L. Designs cannot and does not warrant or guarantee your satisfaction with design services and/or ideas you receive on the E.L. Designs website. Notwithstanding the foregoing, E.L. Designs will take such reasonable steps, in E.L. Designs’ sole discretion, to ensure your satisfaction including, but not limited to, those measures set forth in my refund policy. This offer is valid for three (3) months from service purchase date. While E.L. Designs has made every effort to portray recommended products and their colors and materials in the most accurate way on the website, the displayed colors of the products will depend upon the monitor of the user and cannot be guaranteed by E.L. Designs as an accurate portrayal of the actual color or material of the product. I also make best efforts to estimate the scale of your space based on either a site visit/measure or dimensions and photos provided by the user, but can’t guarantee that all recommended products will fit your space. Regarding e-design, customers are required to measure their space to ensure that items fit prior to purchasing. 

E.L. Designs does not guarantee, or warranty any of the products or merchandise purchased by you through the use of my services or those serviced or a service provider. Your only recourse or remedy for guarantee or warranty claims is directly with the manufacturer or producer of the merchandise.

While E.L. Designs will attempt to ensure that all retail product links and recommendations are in order to assist users with purchasing design materials, there is no guarantee that the furniture or accessories recommended by E.L. Designs will be available for purchase at all or within a specific time frame. If prices are provided as part of the design service recommendation, there is no guarantee that the price is the lower price or that the customer will find the article at the similar price when they order.

REFUND POLICY ON PAID SERVICES

If you are not satisfied with your paid services experience with E.L. Designs services, then you may request specific remedies to correct the situation by emailing erin@eldesignsco.com. At E.L. Designs’ sole discretion, I may offer a refund in those situations where a remedy is not possible or does not correct the issue. You can request a refund by emailing erin@eldesignsco.com. The refund is limited to 50% of the amount paid for the design service within the last billing period.

INACCURACIES

I endeavor to present the most recent, most accurate, and most reliable information on my website at all times. However, there may be occasions when some of the information featured on eldesignsco.com may contain incomplete data, typographical errors, or inaccuracies. Any errors are wholly unintentional and I apologize if erroneous information is reflected in merchandise price, item availability or in any way affects your individual order. Please be aware that I present my content 'as is' and make no claims to its accuracy, either expressed or implied. I reserve the right to amend errors or to update product information at any time without prior notice.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless E.L. Designs, its officers, directors, employees, agents, licencors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

CORRESPONDENCE

Although I will make every effort to respond quickly to applicable email messages and social media outlets (InstaGram, Facebook, etc.), E.L. Designs is under no obligation to respond to any correspondence received through this site, or to maintain your submitted comments in confidence, or to pay compensation of any kind for your comments or submissions. While I welcome your comments and feedback regarding E.L. Designs, my merchandise and my services, I do not wish to receive any confidential or proprietary ideas, suggestions, materials, or information via this website or any email connection. Please note that all of your comments, feedback, ideas, suggestions, and other submissions that are disclosed or submitted to my company through eldesignsco.com shall become and remain the property of E.L. Designs. Any such disclosure or submission by you is a declaration of the full release of all proprietary claims and/or intellectual rights regarding your submission. However, I will not use your name in connection with any such materials, information, suggestions, ideas or comments unless I first obtain your permission or otherwise are required by law to do so.
